These Terms & Conditions (“Terms”) govern access to and use of the website www.dmdgoldprosperity.com (“Platform”) and all domestic and international transactions carried out through it.

By accessing, browsing, or using the Platform, you (“User”, “Customer”, “Buyer”) agree to be bound by these Terms, the Privacy Policy, and all applicable laws.

1. Company Details

DMD Gold Prosperity Pvt. Ltd. (“Company”, “we”, “us” or “our”) is engaged in the manufacturing, wholesale, retail, online sale, and export of gold, diamond, and gemstone jewellery.

2. Applicability

These Terms apply to:

All users visiting or transacting on the Platform
Domestic (India) sales
International/export transactions
Business-to-Consumer (B2C) and Business-to-Business (B2B) customers

3. Eligibility

By using the Platform, you confirm that:

You are 18 years of age or above
You are legally competent to enter into a binding contract
For export transactions, you are legally permitted to import jewellery into your country

4. Product Information & Jewellery Disclaimer

Jewellery images, videos, and renders are for representation purposes only
Minor variations in design, colour, weight, and finish may occur due to handcrafting and manufacturing processes
Gold weight, diamond grading, gemstone quality, and measurements are subject to industry-accepted tolerances
Certifications, where applicable, are issued by recognized authorities such as BIS, IGI, GIA, SGL, GSI, etc.
Any typographical or display errors on the Platform may be corrected without liability

5. Pricing

5.1 Domestic Orders

Prices are displayed in Indian Rupees (INR)
Applicable taxes (including GST) may be added as per law

5.2 Export Orders

Prices may be displayed in INR or foreign currency
Prices do not include destination-country customs duties, VAT, sales tax, import levies, or similar charges unless expressly stated
All such charges are the sole responsibility of the Buyer

6. Orders & Acceptance

Placing an order constitutes an offer to purchase
The Company reserves the right to accept, reject, or place any order on hold without assigning reasons
Orders are considered accepted only after successful payment and order confirmation by the Company

7. Payments

Payments must be made through authorized and secure payment gateways or approved banking channels
For export orders, full advance payment is mandatory
The Company does not store card, UPI, or banking credentials

8. Shipping, Delivery & Risk

8.1 Domestic

Delivery timelines are indicative and may vary
Shipment may be insured depending on order value

8.2 Export

International shipments are made via insured logistics partners
Risk transfers to the Buyer upon dispatch unless otherwise agreed in writing
Delays due to customs clearance or regulatory checks are beyond Company control

9. Customs, Import Compliance & Export Regulations

For export orders:

The Buyer is solely responsible for complying with import laws, customs regulations, and local jewellery laws of the destination country
The Company shall not be liable for seizures, holds, rejections, penalties, or delays imposed by foreign customs or authorities

10. Intellectual Property Rights

All intellectual property including:

Jewellery designs
Website content
Text, images, videos, logos, trademarks

are the exclusive property of DMD Gold Prosperity Pvt. Ltd.
Any unauthorized use is strictly prohibited.

11. User Obligations

Users agree:

To provide accurate, lawful, and complete information
Not to misuse the Platform or engage in fraudulent activity
Not to attempt unauthorized access or data extraction

12. Limitation of Liability

To the maximum extent permitted by law:

The Company’s total liability, if any, shall not exceed the invoice value of the product supplied
The Company shall not be liable for indirect, incidental, or consequential damages

13. Force Majeure

The Company shall not be liable for failure or delay caused by events beyond reasonable control including acts of God, government actions, strikes, logistics disruptions, pandemics, war, or natural calamities.

14. Suspension & Termination

The Company reserves the right to suspend or terminate access to the Platform without prior notice in cases of:

Violation of these Terms
Suspected fraud or unlawful activity
Legal or regulatory requirements

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.
Courts at Pune, Maharashtra shall have exclusive jurisdiction.
